Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Sweep ("the App" or "the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and the provider of Sweep.

We reserve the right to update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.

2. Description of Service

Sweep is a photo and video management application designed to help you organize and clean up your iOS Photo Library. The App provides tools to identify and remove unwanted media, including:

  • Duplicate photo and video detection
  • Similar photo grouping and comparison
  • Screenshot identification and bulk cleanup
  • Large file detection to free up storage space
  • Blurry and low-quality photo identification
  • Storage space analysis and recommendations

All scanning and analysis is performed entirely on your device. No photos or videos are uploaded to any server. We may add, modify, or remove features at any time without prior notice.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for lawful personal use. You may not:

  • Copy, modify, distribute, or create derivative works of the App
  • Reverse engineer, decompile, or attempt to extract the source code or algorithms
  • Sell, resell, sublicense, or transfer access to the Service to any third party
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App to build a competing product or service
  • Use automated scripts or bots to interact with the App

4. Photo Library Permission

The App requires access to your iOS Photo Library to function. By granting this permission, you acknowledge that:

  • The App will read your photo and video library to identify duplicates and organize media
  • All processing occurs entirely on your device — no media is uploaded or transmitted
  • You can revoke this permission at any time through iOS Settings, which will prevent the App from functioning
  • The App uses Apple's PhotoKit framework and adheres to Apple's privacy guidelines for photo access

5. Photo Deletion Disclaimer

Please read this section carefully before deleting any photos or videos.

When you delete photos or videos through the App:

  • Items are moved to the iOS Recently Deleted album, where they remain for approximately 30 days before being permanently removed by iOS
  • During this 30-day recovery window, you may restore deleted items through the built-in Photos app
  • After the recovery period, items are permanently and irreversibly deleted by iOS and cannot be recovered by us or anyone else

You are solely responsible for reviewing and confirming all items before deletion. We strongly recommend:

  • Carefully reviewing each group of duplicates before selecting items to delete
  • Maintaining regular backups of your Photo Library (via iCloud Photos or other backup solutions)
  • Checking the Recently Deleted album after cleanup to verify no important items were removed

We are not responsible for any loss of photos, videos, or data resulting from your use of the App's deletion features. The App is a tool to help you identify candidates for removal — the final decision to delete is always yours.

6. No Guarantee of Accuracy

While we strive to provide accurate duplicate detection and photo analysis, no algorithm is perfect. You acknowledge that:

  • The App may occasionally identify non-duplicate photos as duplicates (false positives)
  • The App may fail to detect some actual duplicates (false negatives)
  • Similarity scoring is based on visual analysis algorithms and may not match your personal judgment
  • Storage space estimates and calculations are approximate
  • The categorization of photos (screenshots, blurry, etc.) is algorithmic and may not always be accurate

You should always review the App's suggestions before taking action on any items. The App is intended to assist your decision-making, not to replace it.

7. Subscription and Payments

The App may offer free and paid subscription tiers. By subscribing to a paid plan, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Allow automatic renewal of your subscription at the end of each billing cycle unless you cancel before the renewal date
  • The Apple App Store's payment terms for all in-app purchases

7.1 Free Trial

If a free trial is offered, you will not be charged during the trial period. Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial expires. You can cancel the trial at any time through your Apple ID subscription settings.

7.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then. To cancel, go to Settings > Apple ID > Subscriptions on your device.

7.3 Refunds

All payments are processed through the Apple App Store. Refund requests must be submitted to Apple in accordance with their refund policies. We do not directly process refunds for App Store purchases.

7.4 Price Changes

We reserve the right to change subscription pricing at any time. We will notify you of price changes before the next billing cycle. Continued use after a price change constitutes acceptance of the new pricing.

8. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable law, regulation, or third-party rights
  • Attempt to circumvent any technical protections or security measures of the App
  • Interfere with or disrupt the integrity or performance of the App
  • Use the App in any manner that could damage, disable, or impair it
  • Attempt to gain unauthorized access to any systems or data associated with the App

9. Intellectual Property

The App, including all software, technology, designs, trademarks, logos, and branding, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license described herein.

Your photos, videos, and media remain your property at all times. The App does not claim any ownership or rights over your content.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DUPLICATE DETECTION. WE DO NOT WARRANT THAT THE APP WILL CORRECTLY IDENTIFY ALL DUPLICATES, THAT IT WILL NOT INCORRECTLY FLAG UNIQUE PHOTOS AS DUPLICATES, OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PHOTOS, LOSS OF DATA, LOSS OF MEMORIES, LOSS OF PROFITS, OR EMOTIONAL DISTRESS) ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES RESULTING FROM THE DELETION OF PHOTOS OR VIDEOS, WHETHER INITIATED BY YOU OR DUE TO ANY ERROR IN THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN US DOLLARS ($10).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sweep and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) any loss of data or content resulting from your use of the App's features; or (d) your violation of any third-party rights.

13. Apple Platform Acknowledgment

If you obtained the App from the Apple App Store, you acknowledge that: (a) Apple is not a party to these Terms; (b) Apple has no obligation to provide any maintenance or support for the App; (c) Apple is not responsible for any claims relating to the App, including but not limited to product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection laws; and (d) Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

Your use of the App must comply with the Apple Media Services Terms and Conditions.

14. Termination

Either party may terminate these Terms at any time. You may terminate by uninstalling the App and cancelling any active subscription. We may suspend or terminate your access immediately and without notice if we determine you have violated these Terms.

Upon termination, your license to use the App ceases immediately. All data stored locally by the App will remain on your device until you delete it. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) shall remain in effect.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration under applicable arbitration rules, except where prohibited by law. You agree to waive any right to participate in class action lawsuits or class-wide arbitration to the fullest extent permitted by law.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of the applicable jurisdiction for any disputes that cannot be resolved through arbitration.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App and uninstall it.
